Form 5472 for a foreign-owned US LLC
If you live in Pakistan and own a US LLC on your own, the IRS expects Form 5472 with a pro-forma Form 1120 from your LLC every year. Many owners miss it because the LLC pays no US tax. The penalty for missing it is $25,000. This is what it is and how to stay on time.
Who has to file
- A US LLC with one owner who is not a US person (a foreign-owned single-member LLC)
- Even with no income or sales, whenever there were transactions between you and the LLC, such as you paying its formation fee or putting money in or taking money out
- A multi-member LLC files Form 1065 instead
Deadline and penalty
- Due 15 April for the previous calendar year
- A 6-month extension to 15 October is available with Form 7004, filed by 15 April
- The penalty for a missing or incomplete Form 5472 is $25,000
